New documents regarding Gens Black Maverick, 2017 Tennessee Walking Horse World Grand Champion, were obtained October 16, 2017. As reported last month, Mr. Bill Callaway began serving a Federal Suspension for violations of the Horse Protection Act (HPA) just after winning the championship for owners Keith and Lorraine Rosbury. USDA documents, Consent Decisions and Orders, showed violations by Mr. Callaway and his brother John Allan Callaway, and both were fined $1,100 each and both began serving an eight-month suspension on the same day – September 4, 2017. [The 2017 National Celebration ran Aug. 23 – Sept. 2, 2017]
Now, additional USDA documents, Consent Decisions and Orders filed on January 12, 2017, show that Gens Black Maverick owners Keith Rosbury and Lorraine Rosbury had violations of the HPA and consented to the settlement agreement. The violation occurred on Saturday, August 27, 2016 when the Rosburys “allowed the entry of a horse [they] owned (Gens Black Maverick) in class 84A” at the 2016 Tennessee Walking Horse National Celebration while sore. Keith and Lorraine Rosbury are disqualified for four months, January 1 – April 30, 2018 “from showing, exhibiting, or entering any horse, directly or indirectly … and from judging, managing or otherwise participating in any horse show, horse exhibition, or horse sale or auction, directly or indirectly…” The Rosburys are also fined a civil penalty of $550 each. Mr. Keith Rosbury, owner of Gens Black Maverick, was awarded the 2017 World Grand Champion Trophy on September 2, 2017, even though their HPA violations had occurred at the 2016 National Celebration.
An interesting part of the Consent Decisions and Orders is that: “the parties consent and agree to the entry of this decision for the purpose of settling this proceeding…, and resolving any and all other alleged or potential violations of the Act (HPA) by [them] occurring up to and including September 4, 2017.”
As reported last month, another document, a DQP ticket from SHOW, shows that Gens Black Maverick, owned by the Rosburys, was sore (HPA violation) at the Mississippi Charity Horse Show in March 2012.
Tunica Fall Classic
The Tunica Fall Classic Horse Show is November 2-4, 2017 at the Paul Battle, Jr. Arena in Tunica, Mississippi. The show is sponsored by the Tennessee Walking Horse National Celebration (TWHNC), and follows the Celebration as the last major “big lick” walking horse show of the 2017 season.
The 2016 Tunica Fall Classic (Nov. 3-5, 2016) followed on the heels of the National Celebration last year, too (Aug. 24- Sept. 3, 2016). Results from the 2016 Tunica event show the Rosburys winning the Amateur four year old stallions division with A King Thing; third in the WHAT Riders Cup with Go Diego Go, ridden by Leigh Stuart; and Gens Black Maverick, ridden by Bill Callaway for Keith/Lorraine Rosbury, taking the TWHNC Championship. The Rosburys also sponsored the “Gens Black Maverick Two Year Old Mares/Geldings/WHAT Riders Cup 2016.”

The TWHNC has selected Sam Sorrell, Robbie Spiller and Leigh Stuart to judge the 2017 show. Information from the TWHNC states that Sorrell and Stuart are veteran judges at the Celebration events. Spiller has judged the Mississippi Charity show, Alabama Jubilee, Columbia Spring show and other shows in middle Tennessee.
A search of the HPA violations records showed that all three of this year’s judges have had HPA violations. More recent records from USDA were not available and have to be obtained through filing a Freedom of Information Act request. These data are from available records.
Sam Sorrell of Kentucky was cited for “unilateral sore” and suspended for two weeks in October 2001. He was cited by the Horse Industry Organization NHSC, the National Horse Show Commission, a group that is certified by USDA to perform HPA inspections at shows.
Robbie Spiller, of Shelbyville, Tennessee, had an HPA violation on Tin Man’s Party 8/03/2012 at the Belfast Lions Club 52nd Annual Horse Show. The horse was “sore.” Case No. TN130121-AC; date of order 12/14/2012.
Leigh Stuart, of Kentucky, had an HPA violation on Santanas Renaissance Man for “foreign substances” on 4/27/2012 at the Gulf Coast Charity Celebration. The foreign substances found were: o-aminoazo toluene and 1,4-bis[(1-methylethyl)amino]9,10-Anthracenedione. Case No.FL130023-AC; date of order 12/10/2012.
The chemical o-aminoazo toluene is an azo dye with carcinogenic properties. NOAA documents show the health hazards of this chemical: “This compound is harmful if ingested, inhaled, or absorbed through the skin. The chemical 1,4-bis[(1-methylethyl)amino]9,10-Anthracenedione is listed in the Toxic Substances Control Act chemical inventory and may also be called Acetate Blue B, Solvent Blue, Oil Blue A, Solvent Blue 36, or any other number of names including Blue, according to the NIST (National Institute of Standards and Technology, U.S. Department of Commerce) Chemistry WebBook. It is a man-made blue dye used in textiles, printing inks, rubber, plastic products, paints, lacquers and varnishes. It has been identified as a potential concern to the environment regarding possible persistence, accumulation and toxicity in the environment.
